The Mediation Process In divorce mediation, each party hires an attorney, but does most work with an impartial mediator. You are requires to go through financial mediation first to determine division of property, child support and alimony. This is also required in contested divorce litigation. Generally, a divorce mediator will meet with the divorcing couple to find out their desires, needs and assets. Then the mediator will present a proposed settlement to each person's attorney. The attorneys then go through the settlement, and share their opinions of its merit with each other and with the mediator if necessary. This step is important. Who Should Not Go Through Mediation? The mediation process requires you and your spouse to negotiate in a civil and constructive way.
