Domestic Violence

Experienced New Jersey Attorneys
Domestic Violence and Restraining Orders

Domestic violence is violence between people who have specific relationships such as spouses, ex-spouses, household members, parents, or persons who are dating or have dated each other. Hurting another person, threatening to hurt another person, or giving that person reason to believe you will hurt them are all acts of domestic violence. Some examples of domestic violence are physical assault, harassment, stalking, and threats.

Domestic violence charges can be levied against men or women, and consequences can include restraining orders, anger management courses, or fines.

At Law Offices of Herman Osofsky, our lawyers have handled hundreds of domestic violence cases, on behalf of both those accused and those making accusations. We can evaluate your case and let you know what to expect. Our practice extends throughout northern New Jersey, including Somerset County, Passaic County, Morris County, Bergen County, Middlesex County, Essex County, and Sussex County.

If you have been accused of spousal abuse or domestic violence, or you have been the victim of abuse or violence, contact us to discuss your particular situation

We are an experienced family law firm, and have handled many domestic violence cases that also involved divorce.

Domestic Violence Restraining Orders

A restraining order is a civil court order which prohibits the alleged abuser from contacting the victim anywhere including at home, at work, or at school. Violating a restraining order is a criminal matter and would be handled by a county prosecutor.

Representing Alleged Victims

If you have been abused or harassed, you need protection. We help people who are making accusations of domestic assault and battery obtain restraining orders and fill out formal complaints. Our lawyers and staff work closely with them in every part of their case: We prepare them for the domestic violence hearing, go through the calendar and series of events, review the events, and build a case. Domestic violence hearings are usually short, and it is vital that clients are prepared to tell their story clearly and succinctly.

In all that we do, it is important that we get to know you and your family. Our attorneys and staff not only get to know your case—we also get to know you, and work hard to get you the protection you need to be safe.

Representing the Accused

With our extensive knowledge and experience, we can represent you if you have been charged with domestic violence, and also represent you in any other family law proceedings. For example, if you are going through both a divorce and a domestic violence accusation, our lawyers will try to get the domestic violence charge dismissed and incorporate the restraining order into the divorce agreement. This can save clients from having to deal with Final Restraining Orders, fines, and other punishments.

Our lawyers have also defended people accused of violating domestic violence orders. The key to our success in theses cases is preparation—we work closely with clients to thoroughly prepare them for every part of their case. We know how to carefully examine the facts of the incident and then build a strong defense.
