How Does Alimony Work?

Also known as "spousal support" or "maintenance," alimony is an agreed-upon or court-imposed obligation of one spouse to pay financial support to the other spouse. Not all divorce cases involve support payments by one spouse to another. Alimony can be temporary or permanent and can be in a lump sum or in a number of payments. Alimony is not subject to a set formula and is decided on a case-by-case basis with the application of New Jersey case law.

Whether or not alimony is awarded is determined by looking at a variety of factors, including: the parties' needs; the ability of one spouse to pay support; the age, physical and mental health of the parties; and the parties' incomes and earning capacities. Other relevant factors are the lifestyle that was experienced during the marriage, the property awarded each party, and whether or not one party needs education or training to become employable.
